Welcome to Solsoma ("we," "us," or "our"). By accessing or using our website, booking system, or participating in classes and services provided by Solsoma, you ("you," "your," or "Student") agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully before using our website or booking any services.

1. Acceptance of Terms & Services

By accessing our website, registering an account, purchasing a pass/membership, or booking a class or appointment with Solsoma, you confirm that you are at least 18 years of age (or have provided Solsoma with explicit written parental/legal guardian consent) and agree to comply with these Terms and our Privacy Policy.

2. Bookings, Payments, & Cancellations

  • Account Registration: To book classes, you must create a student account with Solsoma’s booking systems Momence. This account must contain accurate, complete, and up-to-date information.

  • Payment: All fees for classes, memberships, workshops, and private appointments must be paid in full at the time of booking unless otherwise specified. All prices are listed in Australian Dollars (AUD) and include GST (where applicable).

  • Cancellation Policy:

    • Group Classes/Workshops: Cancellations must be made at least 2 hours prior to class/workshop start time. Late cancellations or no-shows will incur a $10 fee (automatically debited from your card on file).

    • Private Appointments: Cancellations require at least 24 hours’ notice for a full refund or credit. Late cancellations or no-shows will incur a $50 fee (automatically debited from your card on file).

  • Refunds: Except as required under the Australian Consumer Law (ACL), class passes, memberships, and gift vouchers are non-refundable and non-transferable.

3. Health & Medical Disclaimer

  • Assumption of Risk: Yoga involves physical activity and movement. By participating in Solsoma classes, workshops, or appointments, you acknowledge that physical exercise carries inherent risks of physical injury.

  • Medical Fitness: You represent and warrant that you are physically fit and have no medical condition or injury that would prevent your safe participation.

  • Disclosure of Conditions: You must disclose any injuries, health conditions, or pregnancy to Solsoma and your instructor prior to commencing any class.

  • Not Medical Advice: Instructions and guidance provided by Solsoma teachers are for educational and physical practice purposes only and do not constitute medical advice or diagnosis.

4. Third-Party Service Providers & Cybersecurity Disclaimer

Solsoma utilises third-party service providers for website hosting, appointment scheduling, and payment processing (e.g., booking platforms and payment gateways).

While we select third-party service providers with care, Solsoma does not control, and is not responsible for, the cybersecurity measures, policies, or data protection practices implemented by independent third-party platforms. You acknowledge that your interaction with third-party software is also governed by those providers' respective terms and privacy policies.

5. Website Use & Intellectual Property

  • Website Content: All content on the Solsoma website, including logos, text, graphics, images, video material, and layout, is owned by or licensed to Solsoma and protected by Australian intellectual property laws.

  • Prohibited Conduct: You agree not to misuse our website, attempt unauthorised access to our systems, transmit malicious code, or use our content for commercial purposes without prior written consent.

6. Limitation of Liability

To the maximum extent permitted by law, including Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law):

  • Solsoma, its directors, employees, contractors, and instructors shall not be liable for any personal injury, loss, damage, or theft of personal belongings occurring on studio premises or as a result of using our online booking platforms.

  • Our total liability for any breach of a non-excludable statutory guarantee is limited, at our option, to the re-supply of the relevant service or the payment of the cost of having the service supplied again.

7. Studio Rules & Conduct

To maintain a safe, welcoming, and safe environment for all students, Solsoma reserves the right to refuse service or revoke studio access/memberships without refund if a student:

  • Behaves in a disruptive, abusive, or inappropriate manner toward staff or other students.

  • Fails to comply with health, safety, or studio guidelines.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Any updates will be posted on this page with an updated "Last Updated" date. Your continued use of the website or booking services following any changes signifies your acceptance of the revised Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts in that State.
